Consumer Loan Rights in the Czech Republic: Withdrawal and Early Repayment
Signing a personal loan agreement does not mean you must keep the loan until its final instalment. Czech consumer credit law gives borrowers two useful rights: a short period to withdraw from many newly signed agreements, and the ability to repay credit early. Each has different deadlines and payment obligations, so choosing the correct procedure matters.
Which rules apply to your loan?
The main provisions are Sections 118 and 117 of Act No. 257/2016 Coll., on Consumer Credit, as amended, covering withdrawal and early repayment respectively. The Czech National Bank’s guidance on consumer credit explains these protections, including repayment deadlines and limits on compensation.
This guide reflects the rules in force in October 2026 and focuses on consumer loans other than housing loans. These commonly include personal loans from banks and nonbank lenders, whether arranged online or in person. Business borrowing and housing credit require a separate assessment.
Understanding consumer loan rights in the Czech Republic starts with a simple distinction: withdrawal cancels a recently concluded agreement; early repayment settles all or part of an existing debt ahead of schedule.
Withdrawal: the 14-day right to reconsider
When the deadline starts
Under Section 118, you can withdraw from a consumer loan agreement other than a housing loan within 14 days of concluding it, without giving a reason and without a withdrawal penalty.
This protection also applies when you signed at a branch. It is not limited to online applications.
If the agreement lacks the information required by the relevant statutory provisions, the withdrawal period cannot end earlier than 14 days after the lender supplies the missing information on paper or another durable medium. Keep the agreement and any later documents so you can establish when information arrived.
How to send notice
Withdrawal must be in writing, following the withdrawal instructions in your agreement. The deadline is preserved if you send the notice to the lender on paper through a postal service, or on another durable medium, no later than the final day.
Check the designated address and delivery method. If using an electronic route, make sure it satisfies the written-form and durable-medium requirements. A telephone conversation alone does not meet the written notice requirement.
Your notice should clearly identify:
- Your name and the details needed to identify you.
- The agreement number and date.
- Your decision to withdraw from that agreement.
- The date of the notice.
For example:
I hereby withdraw under Section 118 of Act No. 257/2016 Coll. from consumer loan agreement [number], concluded on [date]. Please provide the repayment calculation and payment details.
Keep a copy and evidence of dispatch. Asking for a repayment calculation should accompany a clear withdrawal statement.
What you still have to repay
Withdrawal does not make the borrowed money yours to keep. You must repay without undue delay, and no later than 30 days after sending the withdrawal notice:
- The principal borrowed.
- Contractual interest from the date you drew the money until the principal is repaid.
- Any qualifying non-refundable charges the lender paid to public authorities or bodies exercising public authority.
The lender cannot impose an additional cancellation penalty under this procedure. Ask it to account for any repayments you have already made.
The 14-day notice deadline and the 30-day repayment deadline are separate. Interest continues until repayment, so waiting until the last permitted day can increase what you owe.
If you have already spent the funds, work out how you will return them before relying on withdrawal as a solution.
Early repayment: paying off credit ahead of schedule
Section 117 allows you to repay a consumer loan fully or partly at any time during its term. You also have a right to a reduction in the total borrowing cost reflecting the interest and other costs removed by early repayment.
This option remains available after the withdrawal period has expired.
Notify the lender and obtain a calculation
There is no equivalent 14-day window for exercising early repayment. For an ordinary personal loan, Section 117 does not set a universal advance notice period. Check the agreement’s procedure and tell the lender the amount and intended payment date so it can allocate the payment correctly.
Request a dated calculation showing:
- Outstanding principal.
- Interest payable up to the proposed repayment date.
- The reduction in borrowing costs.
- Any compensation claimed and its calculation.
- Payment details and the reference to use.
For partial repayment, ask whether your monthly instalment will fall or your remaining term will shorten. Obtain the revised schedule before changing a standing order.
An extra transfer without clear instructions can create uncertainty about how the money has been allocated.
How much compensation can the lender charge?
For a consumer loan other than a housing loan, a lender may claim compensation for costs reasonably incurred in connection with early repayment, subject to statutory limits.
| Time between early repayment and the agreed end of the loan | Maximum percentage of the principal repaid early |
|---|---|
| More than one year | 1% |
| One year or less | 0.5% |
Compensation also cannot exceed the interest you would otherwise have paid between early repayment and the agreed end of the loan.
These percentages are ceilings, not automatic fees. The lender needs a basis for the costs claimed, and its contractual terms may be more favourable.
For illustration, repaying CZK 80,000 with two years remaining gives a percentage ceiling of CZK 800. With eight months remaining, that ceiling is CZK 400. The permitted charge may be lower because of the other limits or the lender’s terms.
When compensation is prohibited
The lender cannot claim early repayment compensation where repayment occurs:
- Through an insurance payout intended to secure repayment of the loan.
- For credit provided as an overdraft facility.
- During a period for which no fixed borrowing interest rate applies.
Housing loans have additional rules and exemptions. Their early repayment framework changed from 1 September 2024, with transitional provisions for older fixed-rate agreements. The personal-loan table above should therefore not be used as a mortgage fee calculator. The Section 118 withdrawal right described here also excludes housing loans.
A practical checklist before sending notice or money
- Identify your agreement. Confirm that you borrowed as a consumer and establish whether the loan is classified as housing credit.
- Choose the procedure. Use withdrawal for cancelling a qualifying recent agreement; use early repayment for settling an existing loan ahead of schedule.
- Record the relevant dates. For withdrawal, note when the agreement was concluded, when missing information arrived, and when notice was sent.
- Use the correct contact details. Follow the agreement’s instructions and retain evidence of your communication.
- Check the figures. Separate principal, accrued interest, cost reductions and compensation.
- Protect your household budget. Leave enough money for essential expenses before making an optional early repayment.
- Confirm the result. Request written confirmation of full settlement or an updated schedule after partial repayment.
If a charge looks wrong, ask the lender to explain its legal basis and calculation in writing. Keep the agreement, notices, payment records and correspondence together. An unresolved dispute about withdrawal or early repayment compensation may fall within the Czech Financial Arbitrator’s jurisdiction.
